TM VS. SM

While the term trademark is generally used to refer to both types of marks, marks actually fall into two categories. A trademark specifically refers to goods that are sold, such as a television. A service mark refers to services that are provided, such as a restaurant or a dry cleaner. The real distinction between the two is how you prove to the U.S. Patent and Trademark office how you are using your mark. A trademark is typically shown by using the mark on the product or on the packaging. For example, the Nike swoosh is on all of its shoes. Use of a service mark, in contrast, is shown by advertising. Thus, a Kentucky Fried Chicken (KFC) can rely on the home page of its website or an advertisement in a magazine that shows that it is providing restaurant services.
Using a trademark and owning a federal registration for your trademark is not the same thing. Some companies include a “TM” or “SM” beside their company trademark. This indicates that the company considers that mark as their trademark or service mark, even though they have not officially registered it. Companies that have obtained a federal registration for their mark use the “R” in a circle symbol after their mark. Officially registered companies benefit from increased, nationwide protection of their trademark.
A company’s most valuable asset may be the goodwill associated with its name, or the name of its products or designs, and the associated reputation for quality or innovation. Branding is very important because it designates the origin of the company’s products.
